Terms and Conditions

These terms and conditions relate to the basis on which clients place instructions for Schoolzone off the shelf services as described below.

Schoolzone provides four off the shelf services:

Find a teacher:
The client submits numbers of teacher required and associate profiling requirements via the Find a Teacher online form.

Schoolzone electronically recruits teachers on the client's behalf and screens the respondent data to identify those matching the client profiling criteria most closely.

Schoolzone will endeavour to match the client's stated profiling criteria as closely as possible, however we cannot guarantee an exact match. Where it has not been possible to recruit in line with precise quota, we will find as close a match as possible. In this case the quoted fee is still due for payment in full.

Schoolzone obtains the necessary permission from the respondents to pass their personal data as submitted by them to the client.

Schoolzone cannot verify the accuracy or quality of data received by respondents when submitting their profile data. Spot checks to confirm the identity of respondents may be carried out from time to time by Schoolzone. However, we cannot prevent respondents submitting false or inaccurate information and provide no warranty as to the validity of the data gathered as part of this service. The client accepts this risk and that all fees are due for payment in full.

Within 10 days of the client submitting their request Schoolzone will email the names and contact details, including telephone number and email address ,of appropriate teachers to the named client contact. This is Schoolzone's only deliverable for this service. Schoolzone cannot be held accountable should teachers subsequently withdraw from the project, or fail to deliver. The client accepts this risk and that all fees remain due for payment in full.

Schoolzone is also not responsible for the quality of the work delivered to the client by the named contacts supplied once the project is underway. The client accepts this risk and that all fees remain due for payment in full.

For the Find a teacher" service it is the client's responsibility to pay teachers for all work carried out on their behalf and clarify personal tax arrangements. This will need to be negotiated with the individuals concerned and we will make this clear to the teacher contacts provided. Schoolzone recommends a minimum payment of £20 per hour (excl VAT) for a classroom teacher.

The client also agrees that they will only use the contact data supplied for the research project outlined in the online form, and not for marketing purposes.

Ask a question:
Clients are able to post a maximum of five questions (open text or closed) to a panel of teachers.

The client submits their questions, numbers of teachers required and associated profiling requirements via the Ask A Question online form.

Schoolzone electronically recruits teachers to match the client's profile requirements on the client's behalf and places the client's questions to them. Schoolzone allows 10 working days to gather responses and data will be sent to you within 12 working days of confirming your decision to go ahead.

Schoolzone will endeavour to match the client's stated profiling criteria as closely as possible, however we cannot guarantee an exact match. Where it has not been possible to recruit in line with precise quota, we will find as close a match as possible. In this case the quoted fee is still due for payment in full.

Schoolzone cannot verify the accuracy or quality of data received by respondents when submitting their profile data. Spot checks to confirm the identity of respondents may be carried out from time to time by Schoolzone. However, we cannot prevent respondents submitting false or inaccurate information and provide no warranty as to the validity of the data gathered as part of this service. Response data will be provided to you via email only in spreadsheet format matched to anonomised respondent profiling criteria.

If you are asking a closed question, it will be analysed and presented graphically as a chart, graph or table (depending on the question itself). There will be no analysis provided of open ended, qualitative data responses.

Schoolzone is not responsible for the quality of data delivered to the client by the teacher panel in response to the question asked. The client accepts this risk and that all fees remain due for payment in full.

Pupil Voice:
Clients are able to post a maximum of 10 questions (open text or closed) to a panel of pupils.

The client submits their questions, numbers of pupils required and associated profiling requirements via the Pupil Voice online form.

Schoolzone electronically recruits pupils to match the client's profile requirements on the client's behalf and places the client's questions to them. Schoolzone allows 15 working days to gather responses and data will be sent to you within 18 working days of confirming your decision to go ahead.

Schoolzone will endeavour to match the client's stated profiling criteria as closely as possible, however we cannot guarantee an exact match. Where it has not been possible to recruit in line with precise quota, we will find as close a match as possible. In this case the quoted fee is still due for payment in full.

DIY survey service
The client submits a maximum of 10 questions, in addition to four profiling questions, to Schoolzone together with the graphic they wish to use to promote the survey and the dates for publication (28 days promotion period maximum).

You will be asked to offer a financial incentive for participants, we recommend that an incentive in the form of a £250 prize draw is offered. Schoolzone will administer the prize draw for Data Protection Act purposes.

You will be sent a Research Instruction Confirmation sheet to sign off. Once this has been signed off and FAXed/posted back to Schoolzone the incentive payment you have allocated will fall due for immediate payment.

Within a 10 day period from the date when the client confirms the instruction via the Research Instruction Confirmation sheet, Schoolzone will build and host the survey.

The survey will then be published on the date required specified by the client in the Research Instruction Confirmation sheet and will be promoted via a button on the Schoolzone home page (displaying the graphic pre-selected by the client via the online form) for a period of 28 days.

Please note however that the survey will not be published until the client has paid the sums due, including the incentive fee, direct to Schoolzone. If such payment is not received prior to the client's stated closing date for publication the survey will not be published at all and the full amount due for payment will still fall due for payment.

When the survey is published a link to it will be sent to the client within 24 hours for promotion via other sites, this latter activity being entirely at the clients own discretion and risk.

The survey will be closed and associated promotional material removed from the Schoolzone home page after being published for 28 days.

It is the client's responsibility to remove, or procure the removal, of any links to this survey from their own and other sites after this date.

However, we cannot prevent respondents submitting false or inaccurate information and provide no warranty as to the validity of the data gathered as part of this service. Online forms
Where these are provided for one of these services as outlined above, you will be asked to name and provide contacts detail for a client contact. By clicking the "proceed with this order" form you are confirming that you are entailed to submit this instruction on behalf of the named company and in the manner set out in the online form and are undertaking to pay the associated fees.

You undertake that by submitting the instruction by clicking the "proceed with this order" button in any of these online forms and thereby initiating the instruction and service delivery process, you are not in breach of any contractual, Intellectual Property or other obligations, statutory or agreed limitations on your right to act in this manner and matter. Further that you will underwrite Schoolzone against any legal actions action taken against us arising out of your placing of this instruction.

Schoolzone will send confirmation of the booked service, amounts due for payment and data returned to the named client contact only and via email.

Once the "proceed with this order" button is clicked the amounts set out in the confirmation email fall due for immediate payment. Please note that for DIY Surveys the survey will not be published until payment is received (see above).

Although every effort is made to ensure the accuracy of the costs quoted in the confirming email there may be reasons why these costs could change. All changes to costs will be communicated to the client as soon as possible and agreed in writing prior to commencement of that phase of the work.

Where in the course of a project alterations to the project are agreed in writing (which for the avoidance of doubt in this case includes email communications) between Schoolzone and the client, this will be agreed in writing via an addendum Research Instruction Confirmation Sheet which will be sent to the client for signature and return to the Schoolzone office by post or fax prior to the alteration being put into effect.

Confidentiality and Intellectual Property Rights
As far as is reasonably possible Schoolzone will ensure the confidentiality of the client and work conducted, all data will be held on a secure server. Please note however that data will be returned via email (which can be unprotected) and for Find a Teacher, Ask a Question and Pupil Voice services,
the respondents may become aware of the client's identity and Schoolzone provides no guarantee as to their subsequent behaviour. In the case of the DIY Survey service the client may also choose to make their identity explicit via the survey pages and again this is at their own risk.

Schoolzone may request use details of any project for reference/promotional purposes, but for the first 3 months following the reporting date the client will be contacted first and will be allowed to deny permission.

Except as expressly provided in the Proposal, neither party may use the other party's confidential information. In particular the client may not contact or reuse for purposes unrelated to the project stated in the online form or future work any contacts made via Schoolzone. Please note that Teachers registered with Schoolzone for this sort of work also contract to this effect and that by asking them to work again for you direct, without seeking Schoolzone's agreement will be asking them to breach their contract with us.

Schoolzone assigns to the client any intellectual property rights relating to the data provided under these Terms and Conditions.

After a period of three months from the reporting date Schoolzone reserves the right quote from any reports or raw data unless agreed otherwise with the client in writing.

The client may continue to quote from the data in perpetuity after this three month period provided Schoolzone is quoted as the research provider.
